Alexander W. Kirkpatrick
For over 25 years, Alexander W. Kirkpatrick has focused his practice exclusively on the representation of health care professionals, including physicians, pharmacists, clinical psychologists, physical therapists, and others in a broad range of health care regulatory, administrative, and professional license disciplinary actions resulting from Medicare and Medi-Cal audits and investigations.
Alexander Kirkpatrick has been a practicing attorney in California since 1974. In addition to licensure by the State Bar of California, Mr. Kirkpatrick is admitted to practice in a number of federal jurisdictions, including the U.S. District Court for the Central District of California, the U.S. District Court for the Eastern District of California, the Northern District of Georgia, the U.S. District Court for the Eastern District of Texas, as well as the U.S. Court of Appeals for the Ninth Circuit and the U.S. Tax Court.
After his graduation from Northwestern University, Mr. Kirkpatrick attended the UCLA School of Law, graduating in 1974. He then joined the California Attorney General’s Office, where he worked as a trial and appellate attorney in criminal law for four years, handling many trial court and appellate criminal cases, including over 100 appellate matters in the Court of Appeals and the California Supreme Court. He was selected to join the Bureau of Medi-Cal Fraud, ultimately being elevated to the position of Supervising Deputy Attorney General in charge of the Los Angeles Office of the fraud unit.
Since retiring from the Attorney General’s Office, Mr. Kirkpatrick has worked both in partnerships with other health care attorneys and in solo practice, skillfully representing scores of health care professionals in various matters, including:
- Regulatory, disciplinary, and administrative matters
- Fraud and abuse investigations
- Civil litigation involving practice and partnership disputes
- Federal civil RICO actions
- Office of the Inspector General investigations, including SARK, AKL, and FCA issues
- Medicare and Medi-Cal reimbursement audits, sanctions, exclusions, and penalties
Many professional license disciplinary investigations in which Mr. Kirkpatrick represented the licensee arose from audit or sanctions that had been earlier imposed by Medi-Cal, which then referred its findings to the Medical Board of California. Mr. Kirkpatrick’s familiarity with the Medi-Cal and Medicare program regulations and laws is essential to effective representation in the resulting license investigations.
In addition to administrative and disciplinary proceedings, Mr. Kirkpatrick has extensive experience and an outstanding success rate in representing health care providers in petitions of writ of mandate and petitions for injunctive relief in the Sacramento Superior Court, license disciplinary actions imposed by the Medical Board of California, and in summary suspensions imposed by the Medi-Cal program. Despite the fact that such petitions are rarely granted, Mr. Kirkpatrick has prevailed in 80% of his recent writ petitions. Additionally, Mr. Kirkpatrick has represented physicians and others in appeals of civil and disciplinary matters to appellate courts in California.
Mr. Kirkpatrick is a member of the California Society for Healthcare Law Attorneys, with a focus on Medicare/Medicaid Reimbursement; the Healthcare Law Sections of the American Bar Association and the Los Angeles County Bar Association; and the California Academy of Attorneys for Health Care Professionals. He is also an experienced lecturer, speaking before such large organizations as the American College of Osteopathic Family Physicians, the California Academy of Attorneys for Health Care Professionals, and the Consumer Attorneys Association of California on topics such as Medicare Enforcement.
Mr. Kirkpatrick has earned Martindale-Hubbell’s AV-Preeminent rating, indicating the highest levels of legal ability and ethical standards in the practice of health care law. Most of his cases are referred to him by other attorneys who know of his expertise in this area, or by former clients whose matters he successfully resolved, especially in the areas of Medicare and Medi-Cal audits and sanctions.
